The firm’s constitutional and administrative law practice has been built up over a period spanning more than 45 years, by the firm’s Senior Partner, Mr. Polyvios G. Polyviou, who has litigated some of the country’s most significant cases in this area.
Aside from Mr. Polyviou, the firm’s constitutional and administrative law team implicates a number of the firm’s Partners, including Mr. Levon Arakelian, Mrs. Maria Antoniou and Mr. Nikolas Kallenos.
The firm's work attests to its knowledge and expertise in this area. The firm has repeatedly represented the Cypriot Parliament before the Supreme Court of Cyprus (now, the Supreme Constitutional Court) in disputes between that body and the President of the Republic, primarily concerning the constitutionality of legislation. The firm has acted for multinational energy companies in the successful annulment of competition fines imposed by the Commission for the Protection of Competition. In public procurement, the firm has successfully defended local authorities in cases involving issues of exclusion, false declarations, and de facto corporate control. And in the excise duty and VAT domain, the firm has challenged the imposition of such taxes on constitutional, EU law and international human rights law grounds.
The firm acts for individuals, corporations, public bodies, and others before the Supreme Constitutional Court, the Administrative Court of Appeal, and first-instance administrative courts, as well as before regulatory authorities (such as the Cyprus Securities and Exchange Commission and the Commission for the Protection of Competition), independent commissions, and government departments. It handles cases having to do with judicial review of administrative acts, constitutional challenges to legislation and proceedings arising from the imposition of regulatory fines and penalties.
